Candidate organisation refers to any organisation applying for the EQUAL-SALARY certification.
Data breach refers to a breach of security resulting in the accidental or unlawful destruction, loss, alteration, disclosure or unauthorised access of Personal Data under the control of – or sub-contracted to – the EQUAL-SALARY Foundation.
Data controller (according to GDPR definition): The data controller is the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.
Data Processor: A natural or legal person that processes personal data on behalf of the Data Controller.
Data Subject: The person whose data are processed.
Duration refers to the period of validity of a contract.
Foundation EQUAL-SALARY refers to Fondation EQUAL-SALARY (CHE – 115.518.163), non-profit foundation under Swiss law, based in Vevey (VD), Chaussée de la Guinguette 12.
Intellectual property rights refer to the rights and prerogatives, whether registered or not, deriving from Swiss legislation or from any other national or international legislation, on copyrights, databases, trademarks, domain names, designs and patents, know-how, confidentiality and/or business secrets, and all other intellectual or similar property rights of any nature whatsoever.
Personal data refers to all information relating to an identified or identifiable individual, as defined by Swiss data protection legislation and/or European General Data Protection Regulation.
Platform means the secure online space which serves as a platform for the exchange of information between EQUAL-SALARY, candidate organisations and service providers (“Sub-contractors”).
Services refer to any service provided by the EQUAL-SALARY Foundation within the framework of its mission and purpose as defined by its statutes and registered in the commercial register.
Sub-contracting agreement refers to the sub-contracting agreement between the EQUAL-SALARY Foundation and its audit partners relating to the Personal Data sub-contracted.
Sub-contracted Personal Data refers to Personal Data collected by the EQUAL-SALARY Foundation and transmitted to Sub-contractors as part of the use of Services, in particular EQUAL-SALARY certification, as well as Personal Data received by the EQUAL-SALARY Foundation from a Data Controller and sub-processed by a sub-processor of the EQUAL-SALARY Foundation when the Foundation acts as Processor.
Sub-processor: A sub-processor who processes personal data on behalf of the Data Processor.
Swiss data protection legislation refers to the Swiss Federal Act on Data Protection and its implementing ordinances in their versions in force for the Duration of a contract.
